Mailing of Form 1099s and Annual Statements

Form 1099s will be mailed to retirees and beneficiaries by January 27, 2017.

Annual Benefit Statements and DROP Statements will be mailed to all active members and retirees with a DROP account on January 23, 2017.

Any members on eCorrespondence will receive these communications electronically.

On 2/8, DPFP received notice of a lawsuit filed by the four City Council members who serve as DPFP Trustees, against the eight service Trustees of the Board. A statement from DPFP can be found HERE. The filing can be found HERE and will be discussed in our 2/9 Board meeting.
The Board has scheduled a Special Meeting for Monday, February 27th at 6:30pm. The only item on the agenda is the Rawlings lawsuit and the discussion is expected to be held virtually all in closed session. There will be no opportunity for member comments at this meeting. There will be opportunity for member comments at the next regularly scheduled Board meeting on March 9th.
At its Board meeting on January 12, 2017, the DPFP Board of Trustees called for the 2017 Trustee Election to be held March 24 - April 7. The election notice can be found HERE.
On 2/20, the Board held a Special Meeting to review two Plan Amendment proposals. The Board voted unanimously to support Chairman Flynn’s plan versus the Mayor’s plan. See a summary of the two proposals HERE.
The Board will hold a Special Meeting on Monday, 2/20 at 8:30am. The agenda can be seen HERE.

The temporary injunction hearing scheduled for Tuesday, January 17th in the Rawlings lawsuit has been canceled. Mayor Rawlings requested the hearing date be withdrawn. DPFP statement on this can be found HERE.
Judge Parker in the Rawlings case modified the Temporary Restraining Order to allow the Board to make the monthly installment payments out of DROP. The revised order does not require such payments but permits the Board the discretion to make such payments. This item will be on the agenda for the Special Board meeting for the 29th. Judge Parker’s Order can be viewed HERE.

Letter from Chairman of the House Pensions Committee

A letter, which can be seen at the below link, was received late this afternoon from the office of State Representative Flynn. Representative Flynn serves as Chairman of the House Pensions Committee. It illustrates the importance of the members voting to pass the Plan amendment that will be voted on beginning next week.

2016 Plan Amendment Election

Plan Amendment Election Results

Voting in the 2016 Plan amendment election ended 12/17 at 12pm with the following results as provided by DPFP’s third-party election vendor, Election America, Inc.:

Ballot Item 1 – Plan Changes Related to Benefits – NOT PASSED – 45.0% In favor, 55.0% Not in favor
Ballot Item 2 – Plan Changes Related to Service Trustee Board Positions – PASSED - 66.9% In favor, 33.1% Not in favor
Ballot Item 3 – Requirements to Receive Credit for Additional Compensation Upon the Award of Back Pay – NOT PASSED - 64.8% In favor, 35.2% Not in favor

As a reminder, a vote of 65% in favor is required for an item to pass. Election results are not considered final until certified by the Board. The Board’s review of election results is currently set for a Special Board meeting on December 29th.

The decision by members of DPFP to reject proposed plan amendments for Item 1 and 3 does not change the mission of DPFP and its members, Board and staff. DPFP remains committed to making the necessary adjustments to ensure that Dallas’ first responders can rely on the retirement benefits they have earned.

The voting process was delayed by one lawsuit and occurred during another lawsuit by the Mayor in his role as a private citizen. The delay, along with the actions and statements of the Mayor, the Dallas City Council and City staff, makes it difficult to determine the factors that led to the vote outcome.

DPFP Board and staff are focused on the submission of legislation to the Texas Legislature for its review and action in the upcoming 2017 session.

DPFP Board and staff will also continue to work with the City of Dallas to overcome the current challenges and to try and find a solution to secure the fund so that Dallas’ first responders can continue to rely on the retirement benefits they have earned.

Meetings are scheduled to begin at 1:00 PM on the first Sunday of each month unless the first Sunday is a holiday.

On 12/5, DPFP received notice of a lawsuit filed by Mayor Rawlings, in his capacity as a private citizen, against DPFP. A hearing on Plaintiff’s Emergency Application for Temporary Restraining Order occurred on 12/5, with no determination by the court. The hearing has been continued to 12/8 at 3:30pm. Timing of Annual Required DROP Distributions

Due to the timing of the Rawlings lawsuit hearing on 12/8, the annual Required Minimum Distribution (RMD) payments have been delayed to Monday, December 12th. RMD payments will be made in full. Based on the motion made by the Board on 12/8 to immediately cease all DROP distributions other than RMDs, and the court order on 12/8, (see statement on 12/8 motion and court order HERE), the remaining Required Annual Distribution (RAD) payments will not be made for 2016.

DROP to 401(k) Transfers for Active Members – No Longer Allowed

At the September 8, 2016 Board of Trustees meeting, pursuant to the authority granted under Section 9.01(i) of the Combined Pension Plan (the “Plan”), the Board amended Section 6.14(d) of the Plan to remove the provision allowing for Members still in Active Service to transfer amounts from the Member’s DROP account to the City of Dallas’ defined contribution plan. This action was taken to ensure that the Plan remains qualified under the Internal Revenue Code and is effective immediately.

Important Message about the COLA Rumor!

Rumor Control: It was just brought to my attention that some members of the Police Department are hearing that they must retire prior to January 1, 2017 to protect their COLA. This is incorrect. The truth is that the COLA will be applied to everyone the same way, regardless of their retirement date. There is no difference in the treatment before or after the vote or before or after January 1, 2017. If the Plan amendment passes, the 4% simple COLA will no longer apply for anyone. Please see our informational video or PowerPoint presentation which can be found here for explanation and examples of how the COLA will be applied if the Plan amendment passes. Police Pensioner Trustee John Mays has resigned from the Dallas Police and Fire Pension Board. The Plan requires the Board appoint a police retiree to the open position to serve the remaining term. This term ends May 31, 2017. The Board is seeking interest in the position from current police retirees prior to making an appointment, which is anticipated to occur at the November 10th Board meeting. To express interest in serving on the Board for the remainder of this term, please provide a statement expressing your interest, describing your qualifications and including your contact information. The statement must be received by the close of business on October 31, 2016. At the August 11, 2016 Board meeting, the Long-Term Financial Stability Sub-Committee and DPFP's actuary presented to the full Board recommendations for plan amendments. Recommendations for changes have not yet been approved by the Board and further discussion will take place at a special Board meeting on August 18. Update on Plan Amendment Litigation; Hearing set for June 12

(June 3, 2015, Updated June 11, 2015) The Plaintiffs in the case filed a verified motion to reopen evidence, motion for a new trial and motion for reconsideration. A hearing on these motions is set for June 12 at 10:15 a.m.

The court had previously signed a judgment declaring that the DROP Plan amendments and withdrawal provisions contained in the 2014 Plan amendment do not violate Article 16, Section 66 of the Texas Constitution.
